The following General Conditions of Use and Sale apply to all orders placed on the Track&Field website https://tfstore.com, by the customer to T.FIELD, LDA., with headquarters at Largo Geraldes Castelo Lopes, Number 12, 4ºA, Bloco B. Lisboa, 1750-204, in Lisbon, registered at the Commercial Registry Office of Lisbon under the unique registration and legal person number 517.852.853 (hereinafter "Track&Field").
Track&Field provides Site users with an online shopping platform for items related to sports clothing and accessories.
Definitions:
- We will use "Track&Field", "us" or "our" to refer to Track&Field;
- We will use "you", "your", "user" or "customer" to refer to the customer, user or anyone who makes use of this Site;
- We will use "Platform" or "Website" to talk about the website https://tfstore.com;
- We will use "Products" to talk about Track&Field clothing and accessories sold on the Site.
ACCESS AND USE OF THE SITE, AS WELL AS THE PURCHASE OF AVAILABLE PRODUCTS, IMPLIES FULL ACCEPTANCE OF THE PROVISIONS OF THESE GENERAL CONDITIONS OF USE AND SALE. IF YOU DO NOT AGREE WITH ANY PROVISION HEREIN, DO NOT USE THE SITE.
These General Conditions of Use and Sale ("CGUV") aim to define the rules to be followed when using the Site, without prejudice to the application of current legislation and other conditions in force between Track&Field and you.

1. WHAT DOES THE SITE OFFER?
The Track&Field website is an online store that sells items related to sports clothing and accessories.
IT IS UNDERSTOOD THAT THE PRICES, SALES OR ANY OTHER SALES CONDITIONS AVAILABLE ON THE SITE ARE EXCLUSIVE AND ONLY APPLY TO ONLINE PURCHASES, AND ARE NOT BINDING ON ANY PHYSICAL TRACK&FIELD STORE.
Search tool. If you wish to search for a specific product, using its characteristics or model, simply use the search bar at the top of the Site. If your search doesn't produce any results, try searching again with other words. The most relevant Products will be listed as a search result. You can change the order in which Products are presented according to your preference by selecting other criteria from the arrow icon in the top right corner of the page. You also have the option of filtering the search results, using the column at the top of the search, according to price range, activity, color, size, among other characteristics. At the top of the page, you will find links that facilitate your purchases, direct you to other Product categories, give you access to your account and make browsing the Site faster.
2. HOW CAN YOU REGISTER ON THE SITE?
Registration as a condition of purchase. Simple access to the Site is free and can be done through any device with Internet access, regardless of registration. However, you must be registered to make purchases on the Site. Registration facilitates the purchasing process, by allowing the user to save their personal data and payment methods for future purchases, in addition to maintaining access to their order history in an uncomplicated way.
Completing the registration. To make purchases on the Site, you must be over 18 (eighteen) years of age and be registered on the Site. To register, you must fill in certain personal data, necessary for billing and delivery of the purchase, such as your name, surname, email, NIF, among others ("Personal Data").
Correct and truthful Personal Information. YOU DECLARE THAT THE PERSONAL INFORMATION PROVIDED AT THE TIME OF REGISTRATION IS CORRECT, COMPLETE AND TRUTHFUL, AND YOU UNDERTAKE TO ALWAYS KEEP YOUR PERSONAL INFORMATION UP TO DATE, BEING RESPONSIBLE FOR ANY DAMAGES RESULTING FROM THE FALSE OF YOUR INFORMATION PERSONAL.
All Personal Information provided voluntarily at the time of registration or collected through automated procedures is subject to security measures to prevent unauthorized access, use and disclosure, in accordance with the provisions of Track&Field Privacy Policy.
Track&Field, at its sole discretion, may request additional data and documents that it deems pertinent to confirm the personal data provided, although it is not obliged to do so.
Cancellation or suspension of access. Track&Field reserves the right, at any time, to suspend or terminate any user's access to the Site in the event of bad faith, proven fraud, participation in obtaining an illicit benefit or advantage and/or failure to comply with any of the conditions set out in these GCUV or applicable legislation. If these facts occur, the suspension or termination of access will be carried out without any compensation being owed to the user and without prejudice to any possible legal action or any other questioning on the part of Track&Field.
Login and password confidentiality. Once registered, you become the holder of a personal and non-transferable account. You, the user, are solely responsible for your account and any activity associated with it. Therefore, you cannot share your login and password with third parties and you are solely responsible for their confidentiality, and must immediately notify Track&Field in the event of loss, misplacement or theft of said login and/or password.

3. HOW CAN YOU MAKE A PURCHASE?
Product Selection. To make your purchase, simply select the Products of your choice on the Website, choose the desired color and size and then select "add to cart". You will then have the option to continue shopping or go to checkout. In the latter, you will be redirected to your shopping cart page, where you will have to enter your Postal Code, if you intend to receive it at home, or select the pick-up option in store, as well as fill in any discount coupons, check the delivery time and shipping price (if applicable). You can also buy a gift package, simply select this option. In this case, the package is sent together with the Products to assembly at home.
Checkout. Then, if you have not yet logged into your account, you will be asked for your login (or personal details, if you have not yet registered), as well as your full address and payment details, in order to complete your order. Before finalizing the purchase, the user will have access to the order summary to check the characteristics of the Products. Ultimately, the user's personal and payment data are subject to confirmation by Track&Field, which will not be responsible in the event of delays or cancellations in the delivery of the order due to errors or discrepancies in the data provided by the user. After filling in the address for the order placed, there cannot be any changes, however, in case of discrepancy (for example, address number, missing complement), you must contact info@tfstore.com so that Track&Field can check the progress of the order and the possibility of correcting it.
No reservation of Products. Products added to the shopping cart will not be reserved until the user completes the purchase and may be subject to changes in price and availability. After completing the purchase of the Products, you will receive an email confirming your order.
Product prices. Price information will always appear on the page of the respective selected Product. Product prices may vary depending on the color or print selected. The final value can be viewed after the user selects the color and print specifications. The same Product may be available at different prices on the Website and in the Track&Field physical store and, to purchase the Product at the lowest price, the user must choose the place of purchase. Although Track&Field makes every effort to ensure that prices displayed on the Site are correct, errors may occasionally occur. If Track&Field detects a clear error in the price of one of the Products purchased, you will be informed as soon as possible. If it is not possible to contact you, Track&Field may, at its sole discretion, consider the order canceled and fully refund the amounts paid within 30 (thirty) days.
Shipping costs. The prices of Products on the Site include taxes, but exclude shipping costs, which are added to the total price when you indicate the delivery address, as explained further in these GCUVs. Prices may be changed at any time, without this affecting orders already placed and confirmed by Track&Field (except in the case of a clear error, as stipulated above).
Product unavailable. All orders are subject to the availability of the Products. Occasionally, some Products sold on the Site may be marked as "Product unavailable", which means that the merchandise is out of stock at Track&Field or that there is no forecast for a new shipment. Due to possible errors, there may be inconsistent information about availability and stock of Products. IN THIS CASE, TRACK&FIELD RESERVES THE RIGHT TO CANCEL THE PURCHASE AND REFUND THE FULL AMOUNT PAID WITHIN 30 (THIRTY) DAYS.
Payment Authorization. You declare that you are aware that, by authorizing the payment transaction corresponding to your purchase on the Track&Field platform, you are giving express and individualized authorization to carry out the operation.
4. WHAT ARE TRACK&FIELD’S PAYMENT TERMS?
Track&Field offers several payment methods, as indicated below:

The user must present the details of a card compatible with one of the brands accepted by Track&Field. Possibility of using two different cards. Payment must be confirmed within 72 business hours.

The user must have an active PayPal account and will be redirected to PayPal's secure environment to confirm the transaction. You can use PayPal balance, associated card or other accepted methods.

| MULTIBANK |
Generates a reference, entity and amount to pay. Payment must be made within the deadline indicated on the Website through the Multibanco network or home banking.
|
| MBWAY |
The user provides the telephone number associated with the MBWay account. Confirmation is made via the MBWay app with PIN, fingerprint or facial recognition.

Payment information provided by users, such as credit card numbers, is recorded directly in the database of the card companies, which do not allow access to this information by third parties and which must process the data provided in accordance with the Track&Field Privacy Policy. Track&Field is not responsible for any difficulties in making payment.
5. WHAT IS THE DEADLINE AND METHODS FOR DELIVERY OF YOUR ORDER?
The delivery time for Products varies according to the location, the payment method chosen, the type of delivery and the availability of the Product purchased.
Purchase of more than one item. If more than one Product is purchased, they may be delivered separately or together, depending on the case. The same procedure is adopted in the case of articles of very different dimensions, which require the use of more than one conveyor.
Order tracking. The user can follow the order by accessing the "my account" > "orders" or through the link "track your order" in the footer of the Site (requires login and password).
Delivery types. Consult the specifications of the 2 (two) types of delivery (Express and Normal) and the in-store pickup option at shipments.
THE DELIVERY TIME FOR YOUR ORDER IS CALCULATED IN BUSINESS DAYS AND STARTS ON THE CONFIRMATION OF YOUR PAYMENT AND THE VALIDATION OF YOUR REGISTRATION DATA.
6. WHAT DO YOU NEED TO KNOW ABOUT EXCHANGES, PURCHASE CANCELLATION AND RETURNS?
Exchanges and returns of Products purchased through the Site, or cancellation of orders, are expected situations and the exercise of these rights must comply with the conditions detailed in the link Exchanges and Returns available at the footer of the Site.
7. HOW CAN YOU CANCEL YOUR ACCOUNT?
The user has the right to request the cancellation of their account on the Site at any time by sending an email to info@tfstore.com requesting deletion.
8. DOES TRACK&FIELD OFFER ANY TYPE OF GUARANTEE ON THE PRODUCTS PURCHASED?
Track&Field respects the legal warranty provided for in current legislation only for Products with manufacturing defects. The manufacturing defect will be determined after analysis to verify the reported fault before the return process is accepted. To request analysis of a Product, follow the steps indicated in "Defective Product" in the section Exchanges and returns.
9. WHAT ARE YOUR RESPONSIBILITIES?
Your responsibilities as a user of the Site are:
- Keep the environment of your devices secure (antivirus, firewall, etc.);
- Use updated operating systems and browsers;
- Take responsibility for devices and Internet access;
- Provide personal information correct, complete and truthful upon registration/purchase;
- Use, save and maintain confidentiality of all passwords and logins.
10. WHAT ARE TRACK&FIELD’S RESPONSIBILITIES?
Track&Field is not responsible by:
- Access/browsing failures resulting from circumstances beyond your control (Internet failures, power cuts, breakdowns in telecommunications networks, intervention by hackers/viruses, etc.);
- Access or orders made by third parties using your login and password;
- Accuracy of the personal information provided by the user;
- Content from third-party websites and materials linked to on the Site.
TRACK&FIELD WILL NOT BE RESPONSIBLE FOR ANY ACCESS OR ORDERS MADE TO YOUR ACCOUNT BY THIRD PARTIES USING YOUR LOGIN AND PASSWORD.
11. WHO OWNS THE RIGHTS TO THE SITE?
All intellectual property rights relating to the Site (texts, images, layouts, software, codes, databases, graphics, photographs, logos, videos, etc.) are the exclusive property of Track&Field CO S.A. (CNPJ nº 59.418.806/0001-47).
It is prohibited use, copy, reproduce, modify, translate, publish, transmit, distribute or exploit Track&Field Content without prior express consent. Any unauthorized use will be considered a violation of copyright and intellectual property.
12. WHAT ELSE DO YOU NEED TO KNOW ABOUT THESE CONDITIONS OF USE?
Changes to the CGUV. Track&Field reserves the right to change these GCUV at any time. If you do not agree with the new CGUV, you must stop using the Site. The continued use of the Site after changes implies acceptance of them.
Partial nullity. If any provision of these CGUV is declared null and void, the others will continue to be in force.
Tolerance. Track&Field's failure to require strict compliance does not constitute a waiver of rights.
Events beyond control. Track&Field is not responsible for non-compliance caused by Acts of God or Force Majeure (as defined by law).
Applicable legislation. These CGUV are governed by the laws of the Republic of Portugal. Disputes not resolved directly with Track&Field may be submitted to European Commission alternative dispute resolution platform. The Parties elect the Lisbon forum to resolve disputes.
